In this article the autor claims that accession is not a way of acquiring ownership, but a case of expropiation. In addition, it is argued that building in another's land is a case of unjust enrichment. From this perspective, the dogmatic idea behind the second part of article 669 of the Chilean civil code es the acquiescence of the improvement by the landowner, and this explains the restitutionary duty to pay the total value of the building.
