Legal simulation and appearance have been widely accepted when deciding on issues related to the identification of the employer and to the legal nature of the contract in the workplace. Even though these are rigorously different concepts, and more specifically pertaining to the Civil Law, from the labor stand point they have been treated in a uniform manner, on the understanding that the fulfillment of mandatory rules is sought through them. These legal concepts have been specially applied to solve problems such as identification of the parties to the contract, but they have also been used to avoid falsehood, fraud and abuse of Law.
