The criminal doctrine ascertains that the regulation of criminal law regarding document falsification, heir to the French-Spanish legal tradition, is based on the "authenticity" protection, because there is no "general" right to truth. This makes it different to the criminal regulation of document falsification in Germany, legal tradition of which precisely raised the question of whether such right existed and its denial. Nonetheless, both traditions have a common origin, grounded in the crimen falsi punishment in the Roman Law. Based on the research of these grounds, this historical-dogmatic review is intended to show that document falsification can be broken down into "breach of truth" and that this crime cannot be fully resolved without resorting to the right to truth.
