As in other areas of liability, in terms of environmental damage, there are difficult cases and more obvious ones. Regarding causality, cases of environmental damage are mainly faced with two particular complexities: the plurality of causes and the scientific complexity of the causal relationship test. Given these obstacles, jurisprudence has been developing different tools. Notion of ecosystem service, general and special causality, insignificance of action as a form of attribution of liability, presumptions, among others. This work aims to analyze the judgments on environmental damage and -from causality- demonstrates the poor reciprocity between the Courts. The work ends by concluding that Environmental Courts intend to build a special system of environmental liability that moves away from the traditional categories of civil law. To do this, they apply approaches, concepts and reasoning methods that differ between both Courts, generating complexities by systematizing and understanding the national environmental liability system.
