The author describes and analyzes a recent case of the Supreme Court of Justice that addresses the problem of the limitation period of the non-contractual liability action established in the Chilean Civil Code, exposing the trends of national and comparative doctrine on the matter, recognizing as the right opinion in this matter the one that understand that the term must be counted from when all the liability action elements are gathered in the plaintiff, and not only since the occurrence of the illegal act.
