PONCE DE LEON SOLIS, Viviana. The troublesome appeal to legitimate reliance as a limitation to legislative power. Estudios constitucionales [online]. 2014, vol.12, n.1, pp.429-474. ISSN 0718-5200. http://dx.doi.org/10.4067/S0718-52002014000100011.
This paper critically analyzes the appeal to the legitimate reliance principle, as a limitation to legislative power. To that effect, firstly, it exposes some generalities regarding this doctrine. In light of this exposition it identifies the foundational premises in which the resource to the aforementioned principle relies on, discussing the difficulties posed by their conception and formulation. In this line of thought, it states that the main problem stems from the aspiration to extend to legislatures a concept developed as a guarantee against administrative activity. Finally, it studies the current state of affairs in the Constitutional Court's rulings, in order to determine whether they turn out to be inclined to its recognition.
