The International Court of Justice rejected the objection of incompetence that Chile lodged in its current controversy with Bolivia. To that effect, the tribunal used the classification of obligations according to their content that distinguishes between obligations of conduct and of result, but without expressly mentioning it, as the Court had already done in other disputes submitted to its jurisdiction. With this, the judgment on the merits of this case was limited to a pronouncement of the tribunal on the eventual existence and breach of a pactum de negotiando or of a non-conventional duty to negotiate in good faith, which would not involve the need to reach an agreement. This decision, adopted in a new conflict derived from the Bogotá Pact, seriously challenges the convenience of the permanence of Chile in that treaty.
