This article states that the national regulation does not take into account, in respect of procedures based on self-incrimination, suitable procedural controls on the mandatory exercise of penal action according to the substantive law that should boost the prosecution by law, leaving as a result, multiple, large and important spaces to abandonment or degradation of its exercise of discretion, thus reversing the original model of procedural coding, as displaces in the forensic field, the discretion as to the binding rule in criminal prosecution
