CANDIA FALCON, Gonzalo y SCHLACK MUNOZ, Andrés. SENTENCING PROPORTIONALITY UNDER THE EIGHT AMENDMENT: COMMENTARY TO THE UNITED STATES SUPREME COURT DECISION OF MAY 17TH 2010, GRAHAM V. FLORIDA, 560 U.S. 2010. Rev. chil. derecho [online]. 2011, vol.38, n.1, pp.139-161. ISSN 0718-3437. http://dx.doi.org/10.4067/S0718-34372011000100007.
The United States Supreme Court decision in Graham v. Florida forbade life imprisonment without the possibility of parole for offenders under 18 years old for non-homicidal crimes, considering it as incompatible with the Eight Amendment. In order to reach this decision, the Court created a categorical rule, previously applied only to death penalty cases. Although the authors agree on the lack of proportionality of the punishment imposed on the defendant, the use of a categorical rule is criticized, considering preferable the case-to-case narrow proportionality approach.
