In this paper we claim that the distribution of benefits is a matter of constitutional relevance, insofar as it involves considerations of public sector integrity, equality, fulfilment of the general interest and other analogous to those underlying the constitutional treatment of takings. Notwithstanding, this is an issue that has gotten scant attention from a constitutional perspective. To remediate this omission, we propose evaluating the utility of the theoretical framework developed by Bell and Parchomovsky based on the notion of “regulatory givings”, through an analysis of its contributions and shortcomings.
