IRURETA URIARTE, Pedro. The principle of labor reasonableness. The limits to the employer’s rights in the Chilean employment law. Ius et Praxis [online]. 2020, vol.26, n.2, pp.1-31. ISSN 0718-0012. http://dx.doi.org/10.4067/S0718-00122020000200001.
The statement of reasonableness has traditionally been incorporated into the principles of Labor Law. Even though it is not expressly mentioned, in the Chilean Labor Code there are different norms in which reasonableness is used as a criterion of justification, acceptability or application of procedural rules. Courts have also invoked the maxims that underlie this principle, limiting the faculties of the employer, sanctioning discriminatory behaviors, fixing the scope or credibility of the contractual conditions, or evaluating the justification for the termination of the contract, among other options.
