This is the third article in a series of four that seek to provide a comprehensive analysis of the formation of consent or agreement by electronic means. Its focus is on the moment of formation of agreement, and it seeks to determine, in accordance with contemporary trends in European law, which of the classical civil law theories about consent is a better match for the problem of defining the moment of consent in the case of an electronic contract.  Given that the notions of time and distance are relative concepts in virtual time and space, classical legal reasoning is ill-equiped to solve the dilemmas posed by the analysis of the moment and place of formation of the electronic agreement.
