One of the most powerful indigenous peoples' claims over the last decades has been the recognition of land rights. Indigenous peoples consider that they have an immemorial entitlement to use and possess the lands they occupy or have traditionally occupied. They find in their own law the best argument to support this claim. Such an entitlement to possess and own lands has increasingly been accepted by foreign and international courts, which constitute a noteworthy recognition of indigenous rights. International and comparative case law might inspire judgments of our national courts about this matter.
