This article analyzes the protection of fundamental rights within the framework of the relationship between international and internal law. The core of our analysis is the Inter-American system, and its bodies of application: the Inter- American Human Rights Commission and Court. We consider procedural dimensions as well as precautionary measures pertaining to the latter. Finally, we examine the preeminence of the international law of human rights over internal law, on grounds of the "Barrios Altos" case (Chumbipoma Aguirre et al.), decided on March, 2001 y the "La última tentación de Cristo" case (Olmedo Bustos et al.) decided on February 5, 2001.
