This article presents a reflection on the use on the concepts of person and of protection of the right to life. We challenge the thesis that human life could be protected without acknowledgment of the legal status of the biological being that supports it. We show how the concept of person has evolved from a non-technical usage to a legal-technical meaning, linked with patrimonial capacity (characteristic of nineteenth century Civil Law), to finally acquire a value-based or institutional connotation, which from its origin in Constitutional and International Law, influenced a new interpretation of the norms of the Civil Code, which until recently, were thought to deny full legal status to the unborn, and to postpone instead such recognition to the moment of birth. This new interpretation stresses how, in the new discourse, the concepts of human being, person, and right to life are intertwined, and thus, in Chilean law, it follows that the protection of the right to life of the unborn is based on the acknowledgment of its full legal status as an individual human being from the moment of fertilization.
