This paper examines the current status of the error on personal qualities in the recently issued Civil Marriage Act N 19.947. This work begins by examining the way error was considered by the courts and the authors before this new act. it turns next to the treatment that the new act gives to error on personal qualities, highlighting the role of ius conubii and of family as a societal foundation in shaping the notion of this kind of error. Secondly, it examines what the law understands by the notion of personal quality, distinguishing it from what does not stand as such. Thirdly, it seeks to find the legal meaning of the expressions "nature" and "essential goals", applied to marriage. Finally it suggests to judges a double test to evaluate the admissibility of error as a cause for nullification of marriage.
