This paper tackles one of the most problematic aspects of the Chilean appeal for the protection of constitutional rights, namely, whether the appeal can be filed against court decisions. The Chilean appeal is compared to a Spanish similar recourse, and from the identification of the differences in this point between Chilean and Spanish a thesis is advanced according to which the appeal for the protection of constitutional rights can be filed against judicial decisions only in exceptional cases.
