In the present paper the author examines the personal experience vicissitudes of the declarative action of unconstitutionality in the federal Argentine frame versus the actions that are merely declarative; the metamorphous the first topic mentioned has suffered in the perception of the jurisprudence of the Supreme Justice Court of the Nation; its limitation in the guidelines of the article 322 of the Civil and Commercial Legal Code of the Nation; and its use and value as a functional tool inside the constitutionality control system. To complete the analysis chart and in function of the federal Argentine state structure, a descriptive designation of the different constitutional provisions and, in some cases, infra-constitutional provisions of Argentine provinces and the Autonomous City of Buenos Aires in relation to the declarative action of unconstitutionality in the respective local boundaries is undertaken.
