Even if a social organization without ownership rights could be imagined, it is not possible to assume a state without possession. Since possession is nothing more than the fact that a person physically has one thing in his hand, his imaginary elimination would entail the suppression of things, because they have legal relevance to the extent that we can use them. Being a mere factual situation, often provisional, possession has become one of the most complex legal problems in our private law. In this work we will deal with the case of those who own the good as owner because they have acquired who appeared to be and who, for various reasons, has not become owner. In those cases, with certain conditions, the law grants special protection to the holder even above the true owner.
