In this article, the place of the oath of office in a culture centered around jurisdiction is examined, within the context of the discipline of office with jurisdiction. Considering obtaining an office as a certain process consisting in three acts or stages, namely, the election, the acceptance and the exercise, the jurist's opinions who regarded the oath as an express recognition of acceptance of the office is explained, as confirmed by the practice observed in the different realms of the Catholic monarchy.
