The article analyzes the jurisprudence of the Supreme Court relapsed in the action of inapplicability of legal precepts during the Constitution of 1925. The jurisprudential study seeks to discriminate the judgments that are resolved on the constitutionality of procedural defects to evaluates the areas in which recurrently defects were raised; and the reasoning of the Supreme Court to justify the inadmissibility of the action of inapplicability for this type of unconstitutionality.
