A sentence from the Court of Appeals from Talca reduces the amount of an economic compensation. Said reduction, is based in the existence of goods that will make up the community property when the marital property regime is settled. With this veredict the Court establishes what in the German civil doctrine is known as the double valuation of assets and liabilities ban. The objective of this essay is to examine the foundation of the incorporation of the marital property regime to establish the economic compensation from a dogmatic perspective.
