The Roman operis novi nuntiatio evolved from being a particular prohibition imposed by the injured party against the constructor, until it turned itself into the beginning of a legal procedure. The Spanish legislation of the XIX Century (and, by way of its influence, the Chilean Code of Civil Procedure) established an injunction trial that allows an extended and often unjustified suspension of the works, which lead to the abuse of this procedural tool.
