Resumen

FUENTES ORELLANA, María Fernanda. The Right to Honor as Limit to the Freedom of Information up to the Moment of Filing Criminal Charges. Revista de Derecho de la Pontificia Universidad Católica de Valparaíso [online]. 2011, n.37, pp. 547-564. ISSN 0718-6851.  http://dx.doi.org/10.4067/S0718-68512011000200014.

This work proposes a solution for the conflict between the fundamental rights to honor and the freedom of information, arisen during the first stages of the criminal process until the charges are filed. By way of balancing the limitations reciprocally imposed by both rights and based on the principle of proportionality, the doctrinal and jurisprudential reasons that allow determining when the need to prefer honor over freedom of information in the criminal court are obtained.
