This article examines forced disappearance of people according to the criminal Law of Brazil; and establishes that this concept has not been legally classified in the Brazilian legal system. Due to the foregoing, the Brazilian criminal jurisprudence has found difficulties, especially in extradition cases, where the requiring State has characterized said offense in their internal legal system and extradition is requested based on it.
