In order to seek beneficial changes for the brazilian Penal Procedural Law, especially with concerning the failed prison system and the respect and observance of constitutional normative dictates and principled, after the publication, enters in vigor the Law 12.403/11, that changes devices of the Penal Procedural Code concerning the theme of procedural prisons and the precautionary measures of process. In this sense, the present article, without pretending to exhaust the theme, aims to delineate a little brief crital essay about the (un)happy changes and the practical implications brought about by new law, from a interpretative reflection which the paradigm is the Federal Constitution of 1988.
