This research deals with the figure of the forced arbitration in Chile, in the area of domestic arbitration. It analyzes specifically the inconsistency that presents this compulsory figure of arbitration in relation to the fundamental principles and rights of freedom, equality and effective judicial protection that enshrined in the Constitution of 1980, and it is proposed in consequence a thorough review of existing legislation on this matter.
