The role of Judicial Review in the debate of the Democratic State is tackled by Habermas, on the one hand, criticizing the content of the constitutional parameter that the constitutional courts use, but, at the same time, revitalizing the role that these courts play in the protection of a deliberative politic which guarantees a democratic coexistence.
