The article discusses the various posibilities of justification of abortion, particualarly in relation to the state of necessity as it has been enshrined in the new article 10 N° 11 of the Penal Code. This purpose is done studying the various ways that the state of necessity can assume, which may be justificatory or exculpatory; defensive or aggressive. All are analyzed in relation to the particular characteristics of the crime of abortion in response to the constitutional, criminal and sanitary regulation that is applicable
