The Institute of substitution of sentence provided in articles 53 and 54 of the Juvenile Criminal responsibility Law is new to our system and key to the fulfillment of the juvenile sanction. Despite its significance, it has received little attention. This work fits this institution in the International Law of human rights and reviews its regulation in several countries. It analyze the legislation according the numerous edges that practice has exposed, and it considers the relevant case law, providing criteria to be considered at the hearings where the substitution is discussed.
