The present work meets two purposes: First of all, to explain what is the relation between procedural equality and judge's probative activity. Thus, to define if the ex officio jurisdictional initiative related to proofs can lead to achieve procedural balances when individuals are surrounded by substantive inequality. Secondly, to define the role to be assumed by the judge according to the equality requirements which involve a trial. These requirements are entrusted to the judge in the Civil Procedural Code Project.
