In this paperwork the author becomes responsible for the criticisms received from Professor Michelle Taruffo regarding the probatory powers of the judges and their association with the prosecuting authoritarianism. He specially takes care of underlying which have been the true postulates he has done on this subject, being concerned of noticing about those matters that may not be conferred to him. In this magazine, two works of professor Taruffo have been published, which can be checked in volumes I and II of year 2006
