One of the most controversial procedural institutes of the civil justice reform is analyzed in this article, which is a provisional execution of the judgments, as a mechanism to get closer to the temporary horizon for an effective jurisdictional response. Bearing in mind the challenges that should be taken over in order to overcome the current problems that the Chilean Justice suffers; the authors analyze the involvement of the new Spanish civil prosecution Act for the revaluation due to the importance of the first instance trial through the new regulation of the provisional execution of the judgments
