This article analyzes from 1818 through 1981 the legal regulation concerning the mining easement for occupying superficial servient estates with water channels and pipes, and its relationship with the mines and mining plants´ so called water rights, uses and easements. Likewise, this article analyzes the doctrinal discussion that took place in the second half of the twentieth century about the legal statute for the establishment and exercise of the aforesaid easement, after the enactment of the 1951 Water Law Code.
