In this article, the topic of the rights of the native people in Latin America is stated and analyzed, considering an outlook of legal and historical backgrounds and Roman Catholic Church documents until arriving at out contemporary reality. In this final outlook, the judicial regime of protection of the indigenous rights in the Political Constitution and the current public law in Argentina are analyzed.
