This article addresses the origin of joint stock companies within the Hispanic legal tradition and its development as of the XV Century with the "avería" in the world of the Indies. Its progressive development and transformations are studied and they are compared to the large companies and societies simultaneously formed within other legal traditions. We conclude this analysis with the regulation of the joint stock companies in the republican Law before the codes were written.
