This article refers to the criminality problem during the colonial period in Chilean, which corresponds to the Absolutist State in Europe. This period is characterised by an extreme criminal legislation, in terms of its inquisitive procedures and in the execution of the sanction. Also, it establishes a summary revision of the legal historiographic literature as a state of the art presentation.
